EUROPEAN INTEGRATION AS A DETERMINANT IN THE FORMATION OF THE LEGISLATIVE PLATFORM OF THE FOREIGN CRIMINAL AND LEGAL POLICY OF UKRAINE

The article is devoted to a comprehensive analysis of the impact of European integration on the formation of the legislative platform of Ukraine’s foreign criminal law policy. The essence of foreign criminal law policy as a system of strategic actions and decisions of the state aimed at ensuring law and order and combating crime at the international level through cooperation with other states and international organizations is considered. The evolution of the mechanisms for implementing this policy is highlighted, in particular its transition from an auxiliary tool for combating crime to a system-forming factor of internal criminal law modernization.
The normative and legal acts aimed at introducing anti-corruption mechanisms, the institution of special confiscation, extraterritorial jurisdiction, special pre-trial investigation and judicial proceedings in absentia, as well as mechanisms for cooperation with international institutions are analyzed.
It is shown that European integration is not only an external political reference point, but also a system-forming factor in the transformation of the criminal law of Ukraine. It contributes to the conceptual transformation of criminal law institutions, strengthening anti-corruption mechanisms, expanding jurisdiction and developing international cooperation, forming a comprehensive legislative model capable of ensuring effective protection of public goods and transnational interests of Ukraine. At the same time, the need for a transition from reactive implementation to a strategically balanced, doctrinally coordinated policy is emphasized, which will ensure the systematicity and effectiveness of the state’s external criminal law activities.
